Representative Litigation Successes

  • Successfully removed the incumbent operator of seven oil and gas wells governed by a joint operating agreement (JOA) and secured appointment of the client’s preferred operator.
  • Obtained injunctive relief and summary judgment allowing an operator to install a saltwater disposal line across private land, while defeating the landowner’s trespass claim. Judgment affirmed on appeal.

  • Secured summary judgment quieting title to a 4% overriding royalty interest (ORRI) in a six-section water-flood unit and recovered six figures in unpaid proceeds accrued prior to judgment.

  • Obtained defense judgment for successive operators against a claim by a non-operating working interest owner alleging misapplication of a non-consent penalty in a horizontal well. Judgment upheld on appeal.

  • Achieved early voluntary dismissal of all claims against client, minimizing litigation exposure and economic impact.

  • Defeated plaintiff’s $469,484.36 claim via dismissal and secured summary judgment on a $570,958.00 counterclaim. Plaintiff recovered nothing; defendant obtained full recovery.

  • Compelled arbitration in response to a contractor’s claim tor $22,426.50 plus punitive damages and fees. Obtained a defense award of $111,502.52, including attorney fees. Plaintiff recovered nothing; defendant was awarded full relief.

  • Won summary judgment quieting title to mineral rights under a pre-statutory Pugh clause lease, on a claim for breach of the implied covenant to further develop.

  • Judgment in favor of landowner client declaring road across client’s property to be private, as opposed to public as alleged by oil company.

  • Successfully defended multiple Oklahoma and Texas entities and their Oklahoma-resident proprietors against a lawsuit brought by members of one of Brazil’s wealthiest families on numerous claims totaling millions of dollars in alleged damages relating to the care and breeding of high-end horses. After a set of devastating depositions and more than a year of litigation, plaintiffs voluntarily dismissed all claims.

    Obtained injunctive relief and summary judgment allowing an operator to install a saltwater disposal line across private land, while defeating the landowner’s trespass claim. Judgment affirmed on appeal in Case Nos. 121,605 and 121,606.
